These Terms and Conditions ("Terms") govern your use of the Bio-Urns website and the purchase of our products. By accessing this website and purchasing our products, you agree to be bound by these Terms.

 

1. Definitions

 

"Bio-Urns" refers to our company Bio-Urns Ltd, which consists of Bio-Urns and Bio-Urns Pets, both of which provide living terrarium urns for cremation ashes.

"Website" refers to www.bio-urns.co.uk and www.bio-urnspets.co.uk or any other related website owned and operated by Bio-Urns or it’s agents.

"Customer" refers to anyone using the Website or purchasing our products.

"Product(s)" refers to our Bio-Urns and Bio-Urns Pets, which are living terrarium urns for cremation ashes.

"Agreement" refers to these Terms and Conditions.

 

2. Product Information

 

Bio-Urns makes every effort to provide accurate and up-to-date product information on the Website. However, we do not guarantee the accuracy of the information and products may vary from the images and descriptions provided.

 

3. Orders and Payment

 

Orders are subject to availability. Bio-Urns reserves the right to refuse or cancel any order at any time.

Prices for our products are subject to change without notice. The price in effect at the time of your purchase will apply.

Payment is required at the time of order placement. We accept bank transfer only.

 

4. Delivery

 

Bio-Urns will make reasonable efforts to deliver the products to the address provided. However, we do not guarantee specific delivery times.

Free delivery is applicable to addresses within Norfolk, UK, however for addresses outside of this area, we would need to provide you with a delivery quote. Bio-Urns is not responsible for any delays or issues caused by supplier availability.

5. Bio-Urns are Living Ecosystems

 

In our Bio-Urns, we cultivate vibrant ecosystems where life thrives. Since it's a flourishing habitat, you might encounter tiny insects within. We use small sealed bags of specialised soil and take utmost care to limit natural life entering the urn, yet in nurturing an ideal environment for plants, it inadvertently fosters conditions for tiny eggs to hatch. 


These tiny eggs, while hardly visible to the naked eye, could be found on plants or even within the sealed soil, which is a natural substrate containing a mix of organic materials. We've also chosen not to bake the soil first as this would deplete the soil's nutrients.


If the idea of encountering small creatures unsettles you, perhaps a living urn might not align with your preferences for your cremation ashes. 

If you decide to proceed with a living urn and happen to encounter an unexpected tiny guest, please know that we have a dedicated section on our website with helpful tips on how to address the situation.

 

6. Returns and Refunds

 

Due to our product being a bespoke product using the cremation ashes supplied to us by the Customer and us not being able to guarantee life, we are unable to accept returns and offer no refunds.

 

7. Privacy Policy

 

Bio-Urns’ collection and use of personal information are governed by our Privacy Policy, which is available on the Website.

 

8. Intellectual Property and Trade Marks

 

Bio-Urns is a registered Trade Mark in the United Kingdom.

All content on the Website, including text, images and designs, is protected by copyright and other intellectual property laws. You may not use our content without permission.

 

9. Limitation of Liability

 

Bio-Urns is not liable for any indirect, incidental or consequential damages arising from the use of our products or Website.

 

10. Governing Law

 

These Terms and the Agreement are governed by the laws of the England.

13. Cremation Ashes Permission and Usage

 

13.1 The Purchaser represents and warrants that they have the legal right, authority and ability to provide the cremation ashes for the purpose of creating a Bio-Urn.

 

13.2 The Purchaser acknowledges that they are either the legal owner of the cremation ashes or have obtained explicit permission and authority from the legal owner(s) to use the ashes in a Bio-Urn.

 

13.3 The Purchaser shall be solely responsible for ensuring that the ashes provided do not violate any legal or contractual obligations, including any restrictions imposed by the deceased person's will, estate planning documents or other legal agreements.

 

14. Usage of Cremation Ashes by Bio-Urns Ltd

 

14.1 Bio-Urns shall only use the cremation ashes provided by the Purchaser for the specific purpose of creating a Bio-Urn, as described in the order placed by the Purchaser.

 

14.2 Bio-Urns shall not use the cremation ashes for any other purposes, including but not limited to commercial resale, research or any activities unrelated to the creation of the Bio-Urn.

 

15. Indemnification

 

15.1 The Purchaser shall indemnify and hold Bio-Urns harmless against any claims, damages or liabilities arising from the use of the cremation ashes, including any claims related to the ownership or authorisation to use the ashes.
